Every act or omission designated as a misdemeanor in this chapter, unless otherwise provided, shall be punishable before the circuit court of the county or a trial magistrate of the county, and the offender shall, upon conviction, be subject to a fine nor exceeding one hundred dollars ($100.00) or thirty (30) days in the county jail, or both, in the discretion of the court. Where such an act or omission is of a continuing nature or is persisted in violation of the provisions of this chapter or of any ordinance, rule or regulation promulgated thereunder, a conviction for one (1) offense shall not be a bar to a conviction for a continuation of such offense subsequent to the first or any succeeding conviction.
